This panel will explore how s.718.2€ principles (often known as Gladue factors) have evolved in Canadian law and how they continue to shape sentencing for Indigenous peoples.The discussion will review the most important cases in this area in Nunavut and beyond over the last five years. Moving beyond case summaries, our panelists ask:

-How have s.718.2(e) principles been interpreted and applied in our territory and is that reflected in what is happening in other jurisdictions across Canada?

-Where do our courts fall short in recognizing the lived realities of Indigenous accused?

-What direction do we see for s.718.2(e) and sentencing moving forward?

-Expect a lively exchange between the panelists as they “bounce the ball back and forth” on key cases, highlight tensions and progress, and share perspectives on what the future of s.718.2(e) looks like both in Nunavut and nationally.

This session will leave participants with concrete insights into current jurisprudence, comparative perspectives across jurisdictions, and forward-looking commentary on Indigenous justice in Canada.
