What? DUI Law In Canada

  1. Impaired driving law is one of the fastest-evolving areas of Canadian criminal and regulatory law, with major impacts on police powers, Charter rights, and everyday practice. In this session, Métis lawyer Kyla Lee, a nationally recognized defence lawyer and leading voice on impaired driving, will unpack the key developments that every practitioner should understand; whether you practise criminal law, administrative law, or general litigation.
  2. Topics will include:
    1. Roadside Testing & Police Powers: What lawyers need to know about Approved Screening Devices (ASDs), oral fluid drug testing, and the limits of drug recognition evaluations. While ASDs are currently only in use in some communities in Nunavut, it is important for practitioners to understand how they operate and how to challenge them, as their use is expected to expand over time.
    2. Charter Issues: How courts are handling challenges under ss. 8, 9, and 10(b) in the impaired driving context.
  3. This session is designed to give lawyers across practice areas a clear, accessible understanding of the current state of DUI law, while offering practical insights into how these issues affect clients and communities.
